A custodial battle that triggers Spain’s biggest ever judicial crisis


The Spain judicial system has run into one of the biggest crisis it has ever faced, after it has punished a young lady, who allegedly went hiding with her children in order to avoid the action of handing over her children to their father for a brief period, with a serious punishment of five years imprisonment and stripped custodial right for next six years.

The punished lady’s husband, in the past, once faced serious punishment for the charges of domestic violence and abuse levelled against him on the complaint of the lady. Though the couple later reunited, the relation did not work well.

The punished lady has claimed that she was trying to save her children from her abusive husband. She has asserted that as a mother, it was her moral right to take such an action.

The way the family issue have turned into a tug-of-war between the Spanish legal system and its liberal society is bizarre.

It has attained the dim colour of the battle for gender equality in the Spanish judicial system when the liberal organisations, including the feminist organisations, have made statements supporting the claims made by the punished lady.

Those stand against the Spanish court’s verdict argue that the courts of the country are less sensitive to the principles of gender equality and are not aware how the criminal act of abuse take place in families in the new age society.
